NOTICE IS HEREBY GIVEN that the Pasadena Area Community College District of Los Angeles County, California, acting by and through its Board of Trustees, hereinafter referred to as the District, will receive up to, but not later than, the above-stated date and time, sealed bids for the award of a contract for the work generally described as Bid 869, Asbestos and Lead Abatement Buildings K and T.

Submittal of Bid Proposals.  All bids shall be submitted on forms furnished by the District.  Bids must conform with, and be responsive to, the bid documents, copies of which may be obtained from the District as set forth above.  Only bids submitted to the District prior to the date and time set forth above shall be considered.  Bids must be submitted to the location as set forth above.

Bid Documents.  Each bonafide bidder may obtain up to ONE (1) set of drawings and specifications.  Additional sets may be obtained at the cost of reproduction (non-refundable) from the office of the Director of Purchasing.  All checks shall be made payable to Pasadena Area Community College District. 

Documents Accompanying Bid.  Each Bid shall be accompanied by: (a) the required Bid Security in an amount not less than five percent (5%) of the maximum amount of bid (inclusive of any additive alternates): (b) list of proposed subcontractors ; (c) the Non collusion Affidavit, (d) verification of a valid California Business License, (e) Statement of Qualifications.

Bonds.  The successful bidder will be required to furnish a Performance Bond and a Payment Bond, each in the amount of 100% of the Contract Price.  The costs associated with providing these bonds should be included in the total amount of the bid as submitted by the contactor.

Prevailing Wage Rates. Pursuant to California Labor Code Section 1773, the Director of the Department of Industrial Relations of the State of California has determined the generally prevailing rates of wages in the locality in which the work is to be performed.  Copies of these determinations, entitled “Prevailing Wage Scale”, are maintained at the District’s Purchasing office and are available to any interested party upon request.  The Contractor to whom the contract for work is awarded shall post a copy of all applicable prevailing wage rates for the work at conspicuous locations at the site of the work.  The Contractor and all subcontractors performing any portion of the work shall pay not less than the applicable prevailing wage rate for the classification of labor provided by their respective workers in the execution of the work.

            The schedule of per diem wages is based upon a working day of eight (8) hours.  The rate for holiday and overtime work shall be at time and one-half.

Contractors License Classification.  In accordance with the provisions of California Public Contracting Code Section 3300, the District requires that bidders possess the following classification(s) of California Contractor’s License at the time the contract for work is awarded:  Class A or B and ASB Asbestos Removal Certification.  Any bidder not so duly and properly licensed for the duration of the contract shall be subject to all penalties imposed by law.  No payment shall be made for work, labor, materials or services provided under the contract unless and until the Registrar of Contractors verifies to the District that the bidder to whom the contract is awarded is properly and duly licensed to perform the work.

Substitute Securities.  In accordance with the provisions of California Public Contract Code Section 22300 substitution of eligible and equivalent securities for any monies withheld by the District to ensure the Contractor’s performance under the contact will be permitted at the request and expense of the Contractor and in conformity with California Public Contract Code Section 22300.  The foregoing notwithstanding, the Contractor to whom the contract is awarded shall have ten (10) days, following action by the District’s Board of Trustees to award the contract to such bidder, to submit its written request to the District to permit the substitution of securities of securities for retention under California Public Contract Code Section 22300.  The failure of such Contractor to make such written request to the District within said ten (10) day period shall be deemed a waiver of the bidder’s rights under California Public Contract Code Section 22300.

No Withdrawal of Bid Proposals. Any bidder shall not withdraw bids for a period of sixty (60) days after the opening of the bids.  During this time, all bidders shall guarantee prices quoted in their respective bids.

Waiver of Irregularities.  The District reserves the right to reject any or all bids and/or to waive any irregularities or informalities in any bid or in the bidding procedure.

Award of Contract. The contract for the Work, if awarded, will be by action of the District’s Board of Trustees to the responsible bidder submitting the lowest responsive bid.  If the bid requires bidders to propose prices for alternate bid items, the District’s selection of alternate bid Items, if any, for determination of the lowest priced bid and for inclusion in the scope of the contract to be awarded, shall be in accordance with the Instructions for Bidders. The District reserves the right to reject any or all Bid Proposals or to waive any irregularities or informalities in any Bid Proposal or in the bidding.
